I refinanced in January of 2007 to avoid the adjustable rate and higher payment. I was promised a fixed interest rate, but that did not happen. In December 2007 I requested a hardship program with Countrywide Mortgage Company. On December 21 2007, I faxed Countrywide the documents they requested for the hardship case. This included check stubs and a statement from my Physician about the surgery I was going to have. I was informed by a loan officer that upon receiving these documents my regular payments would be suspended until February 10, 2008 at which time I would resume these payments of $518 per month. After missing the first payment Countrywide started calling me about my payment being late and I told them I had been approved or thought I had been approved according to representative I had spoken to in December. I was asked to resubmit my hardship request and this went on for several months. I was getting further and further behind on my payments. On July 2, 2008 I received a foreclosure notice from the Law Firm of Sirote &amp;amp; Permutt of Birmingham, Alabama. On July 7, 2008, I was again asked by Countrywide to resend the documents mentioned above. I immediately faxed this information to Countrywide's work out department. I then spoke with a Countrywide representative and they confirmed the fax was received and I should check back with them on July 15th. I contacted Countrywide as they requested and was told a workout negotiator was working on this loan and collection was temporarily suspended, this was July 29, 2008. I contacted the Law Firm representing Countrywide and was told even though my mortgage was in work out they would still run the foreclosure notice in the local newspaper. At this point, I really did not know what to do. Every person I spoke with at Countrywide told me something different each time. On August 4, 2008, I filed a Deed in Lieu of Foreclosure at the Covington County Court House. I faxed this information to Countrywide and their Legal Firm. On August 6, 2008, I moved from the property at 26163 Sunnyside Street in Red Level, Alabama 36474. I notified Countrywide that I had vacated the premises and they should send an agent to secure this property. &lt;br&gt;Around December 10, 2008, I received a packet from countrywide mortgage company delivered via FedEx. The packet contained a loan modification of agreement. The agreement contained a lower mortgage rate from 8.625% to 5.5% for the next 5 years, at which time it would revert to 8.625% for the duration of the loan. The anticipated balance was $73,434.59. Remaining term as of January 1, 2009 was 337 months. New principal and interest rate was $428.30. New payment due date was February 1, 2009. I signed and had notarized the loan modification of agreement and returned to Countrywide. Countrywide informed me that documents had been received on December 31 2008. I mailed my first payment in the amount of $428.30 on January 25, 2009. Countrywide cashed the check on January 30, 2009. On February 27, 2009 I mailed a check in the amount of $428.30 for the March payment. This check was never cashed. On Thursday March 26, 2009 I went to Countrywide's web site and logged in to my account. My account stated my loan modification had been canceled as of March 17, 2009. It also stated borrower did not comply with workout plan. I then called and spoke with a Countrywide representative named Jessica. I learned my second check was received on March 9, 2009. Jessica confirmed my loan modification had been canceled and asked that I not send and any more payments and that she would try to put me in another workout program. Jessica told me to call back on Friday March 27 to get an update on my account. I did not call until April 1, 2009 at which time I spoke with another representative. The representative went through all my account records and said none of this made any sense. She had no idea why my modification had been canceled. She then asked if I could pay $1000. No one at this company can give me a valid reason why my modification was canceled. The first payment I sent was put towards an escrow for insurance. I never signed an agreement for any amount to be put in escrow and the contract I signed states 0 escrow. I have made my payments as we agreed and also paid property taxes for 2008. On April 2, 2009, I called and spoke with Countrywide Loan Officer, or so I was told. She too, told me the modification had been canceled and the only reason she could see was that I was behind on my payments. This person asked if I could come up with $2000.00. I replied no and didn't understand why I should. I asked her why my check for the March payment had not been cash. She told me this check was being returned and then I inquired about the check that was cashed in February and after putting me on hold for several minutes she returned and told me that money was applied payments I was behind on. Once again I tried to explain this was a loan modification and all arrears were added to the end of the loan, which of course I'm sure she knew. Rather than go into discussion about arrears and modification cancellations I asked the woman when they were planning on foreclosing this time. She told me there was no foreclosure date at was time, but it could happen at any time. At this point, I didn't know whether to continue to make payments or try to move...yet again. &lt;br&gt;I am now a 61year-old woman, in bad health and had to go disability due to health reasons. I have had to move 3 times since August of 2008 and this situation has put me under an enormous amount of stress and financial hardship. I know I'm not the only person who has been through this trying situation with Countrywide/Bank of America.
